Terms of Service

These interim terms ("Interim Terms") apply to your use of the GeneX website and to any account you create with GeneX while our full subscription agreement is being finalized. By creating an account or using GeneX, you agree to these Interim Terms.

1. Who we are.

GeneX is operated by EASTAR ASSET MANAGEMENT LIMITED, a company registered in Hong Kong (Company No. 2379885), with its registered office at Flat/RM 401, 4/F, Wanchai Central Building, 89 Lockhart Road, Wan Chai, Hong Kong ("GeneX", "we", "us").

2. Your account.

You must be at least 16 years old and provide accurate registration information. You are responsible for keeping your credentials confidential and for activity under your account. You may close your account at any time by contacting us.

3. Acceptable use.

You may not use GeneX to send unlawful, deceptive, or unsolicited messages; to infringe others' rights; to bypass messaging-platform rules (including WhatsApp Business Platform policies); or to disrupt or probe our systems.

4. Our service.

GeneX is a software platform that helps you manage customer conversations. We may modify, improve, or discontinue features; material adverse changes to a paid subscription will entitle you to the refund rights in Section 6.

5. Ownership.

GeneX and its content, software, and trademarks are owned by us or our licensors. You retain all rights in the content and data you upload or send through GeneX ("Customer Data"); we process Customer Data only to provide the service to you. Feedback you give us may be used freely to improve GeneX.

6. Fees and refunds.

Paid plans, billing cycles, and auto-renewal terms are shown at checkout. Subscriptions renew automatically until cancelled and can be cancelled at any time from your account. If you are a new customer, you may request a full refund within 14 days of your first payment, no questions asked.

7. Disclaimers.

The service is provided "as is" except as expressly promised in these Interim Terms or your subscription agreement. We do not warrant uninterrupted or error-free service.

8. Limitation of liability.

To the maximum extent permitted by law, our total liability arising out of or relating to the service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect or consequential damages. Nothing limits liability for fraud, death or personal injury caused by negligence, or any liability that cannot lawfully be limited.

9. Changes.

We may update these Interim Terms and will post the new version with a revised effective date. The version in force when you created your account applies to your use.

10. Governing law and disputes.

These Interim Terms are governed by the laws of the Hong Kong Special Administrative Region. If a dispute arises, the parties will first attempt to resolve it through good-faith negotiation for 30 days; failing that, the dispute shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under the HKIAC Administered Arbitration Rules, in English, by one arbitrator.
